What To Do Following a Car Accident

April 29th, 2009

With the number of cars on the road each day and the number of drivers, it is no wonder that most people who drive will be involved in a car accident sometime in their life. We have represented many car accident victims who did not even realize they suffered an injury at the time of the accident. Often times, injuries from vehicle accidents are not immediately apparent. For this reason, you should seek medical attention regardless of whether or not you feel “injured.” The next thing you should do following a serious car accident, especially one with injury or fatalities, is contact an experienced vehicle accident attorney like the ones at Carr & Carr, Attorneys at Law. We suggest the following if you have been in a vehicle accident:

  • Seek medical attention
  • Call the police
  • Get information from other parties involved in accident
  • Take pictures, if possible
  • Note road / weather conditions
  • Never admit fault
  • Never sign anything except police report
  • Never settle with an insurance company
  • Contact Carr & Carr, Attorneys at Law

Slip, Trip and Fall Injuries

April 29th, 2009

Premises Liability is an area of personal injury law that deals with injuries people suffer on someone else’s property. A very common name for premises liability law is a “slip and fall” case or a “trip and fall” case. Regardless of what you call it, it is a very serious area that requires the skills of an experienced premises liability attorney to handle. Slip, trip and fall is a name given to situations in which a person is injured by slipping or tripping and falling due to dangerous or unreasonable conditions on someone’s property. The fall can happen inside or outside the property and can be caused by conditions such as the following:

  • Wet surface
  • Holes
  • Improperly secured mats
  • Hidden drop-offs

A property owner may be liable for the injury under the following circumstances:
The owner failed to maintain the property or created a condition that resulted in injury
If the owner is aware of a danger on his property but does nothing to eliminate the problem or warn others of the defect

If the owner’s actions, or lack of action, cause damage to his neighbor’s property
In these types of cases, it is important to act fast. If you have been injured on someone else’s property, please contact the premises liability attorneys at Carr & Carr, Attorneys at Law today.

Injury Attorney Recall: Fleet Phospho-Soda & Kidney Damage

April 23rd, 2009

In December of 2008, CB Fleet Company, Inc. recalled their over-the-counter colonoscopy preparation drug Fleet Phospho-soda after warnings from the Food and Drug Administration (FDA) and several reported cases of patients developing a kidney problem called acute phosphate nephropathy. In acute phosphate nephropathy, calcium-phosphate crystals deposit in the renal tubules, causing permanent kidney damage that can result in the need for life-long dialysis.

Immediately after the FDA warning, C.B. Fleet Company announced a recall of their OTC products Fleet Phospho-soda® and EZ-Prep Bowel Cleansing System®. Fleet Phosphasoda contains oral sodium phosphate, which was approved by the FDA for OTC use as a laxative.

However, Fleet promoted their laxative for use at very high doses as a bowel prep without adequate warnings about the potential risk for kidney damage for years prior to the recall. Some patients, especially those with known kidney disorders, may have been able to avoid potentially life-threatening acute phosphate nephropathy if proper warnings had been provided.

If you have taken OTC Phosphosoda in preparation for a colonoscopy, radiological procedure or surgery, and have developed kidney problems, contact your doctor immediately to discuss a possible link.

If you used a Fleet Phospho-soda or EZ-Prep Bowel Cleansing System product and have been hurt or injured, you might be entitled to compensation.
