Do You Have to Pay Back Your Health Insurance After a Car Wreck?

Many times clients will ask “Do I have to pay back my health insurance carrier from my settlement?”  Whether you have to pay back your health insurance company will depend on many factors. Most insurance companies will exercise their right of subrogation, meaning that they will exercise their right to be paid back the benefits they extended you during your medical treatment following your collision or other injury producing event.  Some insurance companies, especially those who provided you health insurance through your employer, will not reduce the amount they want to be paid back. Other health insurance companies will agree to reduce the amount they want to be paid back if they can be convinced that it is in their best interests. The recall affects F-150 trucks with model years between 2015 and 2017, as well as model-year 2017 Super Duty trucks. According to a Consumer Reports article on the recall, a faulty door latch or bent actuation cable may impair the proper opening or closing of the vehicles’ doors. Child Car Seat Safety in Oklahoma

According to the Oklahoma State Department of Health, improper car seat use leaves four out of five children inadequately restrained and vulnerable to injury during transport.

When car seats and boosters are installed correctly and properly fitted to a child, infants under age 1 are 71 percent less likely to die in a car crash. Toddler-age fatalities are reduced by 51 percent when the children are properly secured in car seats. Continue reading “Child Car Seat Safety in Oklahoma”

Talk with a lawyer before talking with an insurance company

In the days following an Oklahoma car wreck, you are almost certain to be contacted by the at-fault driver’s insurance company. While many of these representatives are pleasant when speaking with you, the fact that you are receiving phone calls from an insurance company you do not do business with asking about your car crash can be unnerving. For some car crash victims, they respond to this situation by hiring an attorney to represent them: once an attorney has been hired, any questions the insurance company may have are directed to the victim’s attorney. Do I Have a Claim if My Car’s Airbags Don’t Deploy?

Airbags are meant to prevent serious head and neck injuries from occurring in a car accident (or, at the very least, reduce the severity of these injuries). When a wreck occurs and your car’s airbags do not deploy as intended, you and your passengers may be seriously injured – or even killed. Pat Carr of the Tulsa car accident law firm of Carr & Carr indicates that drivers and/or passengers who are injured by a defective airbag may have a claim for compensation against the airbag manufacturer or automaker, depending on the specific facts of the injury crash. An experienced and knowledgeable car crash attorney will need to evaluate the circumstances surrounding the crash to determine if the injury victim may be able to obtain compensation through a personal injury claim. Types of Car Accidents

There are a wide variety of circumstances that lead to car collisions. No two car accidents are the same – car crashes come about because of a variety of reasons and the ways in which two (or more) cars collide will vary from case to case. These differences and distinctions are significant: The approach used to win one specific car crash victim’s case may not be successful in winning another car accident victim’s case. Is Oklahoma Settlement Money Taxable?

Many people wonder if the money they expect to receive from an insurance carrier is taxable. Generally speaking, money received from an injury or accident settlement is not taxable. According to the IRS, if you receive a settlement award based on a personal injury and did not make a deduction for your medical expenses related to your injury, the full amount is not taxable. However, if you did take an itemized deduction for the medical expenses you paid in more than one year, you must include in income that portion of the settlement that is for medical expenses you deducted in prior years to the extent the deduction provided a tax benefit. Ways a Personal Injury Attorney Can Add Value to Your Case
