Many times clients will ask “Do I have to pay back my health insurance carrier from my settlement?”  Whether you have to pay back your health insurance company will depend on many factors. Most insurance companies will exercise their right of subrogation, meaning that they will exercise their right to be paid back the benefits they extended you during your medical treatment following your collision or other injury producing event.  Some insurance companies, especially those who provided you health insurance through your employer, will not reduce the amount they want to be paid back. Other health insurance companies will agree to reduce the amount they want to be paid back if they can be convinced that it is in their best interests.
