Carr & Carr has recently heard from six families across the U.S. who have suffered tremendous loss, including the death of toddler children, due to accidentally drinking or inhaling tiki-type torch fuel oil. In the United States since 2002, at least 15,445 children under the age of six have been exposed to lamp oil, which includes lamp oil fuel used with tiki-style torches. A very small amount of tiki-style torch fuel can be extremely dangerous and even deadly. If this highly toxic liquid is accidentally swallowed or inhaled, it can cause permanent damage or even be fatal.

Some of the containers that tiki-type torch fuel comes in look remarkably similar to apple juice or white grape juice bottles. Manufacturers add color to torch fuel, which causes it to look like apple juice. Additionally, they also add a pleasant odor and package it in transparent bottles with appealing colorful labels. And, of course, small children can’t read the labels to understand the difference between the deadly torch fuel and juice.

There are certain time limits within which you must file a lawsuit to protect any rights you might have. These time limits are called “statutes of limitations.” If you want to preserve your rights, you must file a law suit against each person or company whom you might make a claim against before the time limits expire. Any person who is sued after these time deadlines will be able to have the claims against them dismissed.
